Agreement to Terms

By accessing or using Pulse ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Pulse is an activity tracking and AI analytics platform that:

  • Monitors activity across connected platforms (Notion, Google Calendar, Gmail, Slack)
  • Analyzes activity using AI to generate insights
  • Creates daily logs in Notion databases
  • Provides dashboards and visualizations
  • Sends daily email summaries and weekly PDF reports

User Accounts

Account Creation

To use Pulse, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Responsibilities

  • You must provide accurate and complete information
  • You must keep your account information updated
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized use
  • You must be at least 13 years old to use the Service

Third-Party Integrations

Pulse integrates with third-party services. When you connect these services:

  • You grant Pulse permission to access your data from these services
  • You are responsible for ensuring you have the right to authorize such access
  • Your use of third-party services is subject to their respective terms of service
  • You can disconnect integrations at any time
  • We are not responsible for the availability or functionality of third-party services

Data and Immutable Records

Important: Activity data collected by Pulse is stored as immutable records. This means:

  • Once activity data is recorded, it cannot be deleted or modified
  • This ensures data integrity and audit trails
  • You can disconnect integrations to stop future data collection
  • Historical data remains stored even after disconnection

By using Pulse, you acknowledge and consent to the immutable storage of your activity data.

Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code, viruses, or malware
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to track others without their consent
  • Impersonate any person or entity

Intellectual Property

The Service and its original content, features, and functionality are owned by Pulse and Winy AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of your data. By using Pulse, you grant us a license to use, store, and process your data solely for the purpose of providing the Service.

AI-Generated Content

Pulse uses AI to analyze your activity and generate insights, summaries, and recommendations. You acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • AI analysis is provided "as is" without warranty
  • You should not rely solely on AI-generated insights for critical decisions
  • We are not liable for any consequences of AI-generated content

Service Availability

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to:

  • Modify or discontinue the Service at any time
  • Perform maintenance that may temporarily interrupt service
  • Limit or restrict access to the Service

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE AND WINY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Indemnification

You agree to defend, indemnify, and hold harmless Pulse, Winy AI, and their officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and data
  • All provisions of these Terms that should survive termination will survive

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Winy AI operates, without regard to its conflict of law provisions.
